Competition Terms & Conditions

These Competition Terms & Conditions apply to all competitions, prize draws, raffles, lotteries and giveaways organised by Birds & The Belles unless otherwise stated on the individual competition page.

2. Acceptance of Terms

By entering any competition organised by Birds & The Belles you agree to be bound by these Terms & Conditions together with any specific terms published alongside the competition.

Where competition-specific terms differ from these general Terms, the competition-specific terms take precedence.

3. Eligibility

Unless otherwise stated:

  • Entrants must be aged 18 years or over.
  • Where a raffle or lottery permits entry by those aged 16+, the minimum age will be clearly stated on the competition page.
  • Employees, volunteers, trustees and immediate family members involved in administering the competition may not enter unless specifically permitted.
  • Entries must be submitted from within the United Kingdom unless otherwise stated.

Birds & The Belles reserves the right to request proof of age or identity before awarding a prize.

4. Competition Types

Birds & The Belles may operate several types of promotions.

These include:

  • Prize Draws: A winner is selected entirely at random from all eligible entries.
  • Skill-Based Competitions: Entrants are required to answer a question, submit a photograph, artwork, written piece or other judged entry. Winning entries will be selected by an independent judge or judging panel using published judging criteria.The judges’ decision is final.
  • Raffles / Small Society Lotteries: Raffles are conducted under the Gambling Act 2005 and the Small Society Lottery Registration held by Birds & The Belles. Tickets are sold in accordance with applicable legislation. Winners are selected randomly.

5. Entry Requirements

Each competition will state:

  • Opening date
  • Closing date and time
  • Entry method
  • Entry fee (if applicable)
  • Prize details
  • Winner selection method
  • Maximum number of entries (if any)

Late, incomplete or illegible entries may be disqualified.

Birds & The Belles accepts no responsibility for entries not received due to technical issues.

6. Free Entry Route

Where legally required or offered, a free postal entry route will be described on the individual competition page.

Where no free entry route is offered, this will be because the competition is operated as a lawful raffle or lottery under the relevant legislation.

7. Raffle Ticket Sales

For raffles:

  • Tickets are sold subject to availability.
  • Payment must be received before tickets are entered into the draw.
  • Ticket purchases are non-refundable except where required by law.
  • Tickets may not be transferred.

Proceeds raised support the charitable and community objectives of Birds & The Belles.

8. Winner Selection

Unless otherwise stated:

  • Prize Draws: Winners will be selected using a verifiably random method.
  • Skill Competitions: Entries will be judged against published criteria.
  • Raffles: Winning tickets will be selected at random after ticket sales have closed.

9. Notification

Winners will normally be contacted using the email address, telephone number or social media account used to enter.

Birds & The Belles may also announce winners on:

  • Our website
  • Facebook
  • Instagram
  • Other official social media channels

Personal information published will be limited to the winner’s first name and county unless the winner agrees otherwise.

If a winner cannot be contacted within 14 days (or another period specified for the competition), Birds & The Belles reserves the right to select another winner.

10. Prizes

Prizes are non-transferable.

No cash alternative will normally be offered.

Birds & The Belles reserves the right to substitute a prize of equal or greater value where circumstances beyond our control make this necessary.

Any images used in promotional material are illustrative unless stated otherwise.

11. Prize Delivery

Where prizes are posted:

  • Delivery is to UK addresses unless otherwise stated.
  • Winners are responsible for providing accurate delivery details.
  • Birds & The Belles is not responsible for delays caused by postal or courier services.

12. Disqualification

Birds & The Belles reserves the right to disqualify entries where:

  • false information has been supplied;
  • multiple entries have been submitted contrary to the rules;
  • fraudulent activity is suspected;
  • the entrant breaches these Terms & Conditions;
  • the integrity of the competition has been compromised.

13. Publicity

By accepting a prize, winners agree that Birds & The Belles may request permission to use their name, photograph and winning entry for promotional purposes.

Participation in publicity is voluntary unless otherwise stated.

14. Intellectual Property

For photography, artwork or writing competitions: Entrants retain copyright in their work. See our Acceptable Use Policy and Terms of Service for more infomation.

By entering, entrants grant Birds & The Belles a non-exclusive, royalty-free licence to:

  • publish the entry;
  • display it online;
  • promote future competitions;
  • use it in publicity relating to Birds & The Belles.

Copyright always remains with the creator unless agreed otherwise.

15. Liability

Nothing in these Terms limits liability where it cannot legally be excluded.

Birds & The Belles shall not be liable for:

  • technical failures;
  • interrupted internet access;
  • lost entries;
  • circumstances beyond our reasonable control.

16. Privacy

Personal data will only be used:

  • to administer the competition;
  • to contact winners;
  • where consent has been given, to provide marketing communications.

Data is processed in accordance with UK GDPR and our Privacy Policy.

Marketing consent is optional and is not a condition of entry unless clearly stated.

17. Cancellation or Changes

Birds & The Belles reserves the right to amend, suspend or cancel any competition where necessary due to circumstances beyond our reasonable control.

Any significant changes will be published on our website.

19. Governing Law

These Terms & Conditions are governed by the laws of England and Wales.

Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
